Commission Agreement

(hereinafter referred to as the "Association")
and the party as stated below in the form
(hereinafter referred to as the "Designer")
§1 Subject of the Agreement
The Association undertakes to sell, in the context of its non-profit activities, products provided by the Designer for upcycling purposes, in the Designer’s name and on their account.
Sales are carried out by the Association in its own name as a commission agent, but on another's account (§ 3 para 3 UStG).
§2 Provision of Goods

The Designer provides the goods to the Association for unrestricted use within its sales premises.

The Association agrees to handle the goods with care and is only liable for loss or damage in cases of gross negligence.
§3 Sales Prices

Sales prices are set in advance by the Designer and communicated to the Association in writing or electronically.

Price changes are possible at any time but must be communicated to the Association in advance.
§4 Booth Rent & Commission
The commission fee for Frau Klotz is 45% of the sales. A final summary of sales and referring payouts will be transmitted monthly
§5 Duration and Termination
1. The contract is concluded for a minimum duration of 2 months and can be extended at any time. A shorter duration is not possible.
2. Upon termination of the contract, unsold goods will be returned to the Designer.
§6 Theft
The NGO is generally not liable for any thefts happening in our space but on a case by case base open for finding fair compromises and solutions.
§7 Miscellaneous

Changes and additions to this contract must be made in writing.

Austrian law applies. Place of jurisdiction is Vienna.
