between

KRAWALL KINDER (Project Herr Klotz)

(hereinafter referred to as the "Association")

 

and the party as stated below in the form

(hereinafter referred to as the "Designer")

 

 

§1 Subject of the Agreement

The Association undertakes to sell, in the context of its non-profit activities, products provided by the Designer for upcycling purposes, in the Designer’s name and on their account.
Sales are carried out by the Association in its own name as a commission agent, but on another's account (§ 3 para 3 UStG).

 

 

§2 Provision of Goods

  1. The Designer provides the goods to the Association for unrestricted use within its sales premises.

  2. The Association agrees to handle the goods with care and is only liable for loss or damage in cases of gross negligence.

 

 

§3 Sales Prices

  1. Sales prices are set in advance by the Designer and communicated to the Association in writing or electronically.

  2. Price changes are possible at any time but must be communicated to the Association in advance.

§4 Booth Rent & Commission

  1. The Association receives a fixed monthly booth rent:

  • Option 1 – Two-tier clothing rack – €100

  • Option 2 – Two-tier clothing rack + 1 table – €120

  • Option 3 – Table only – €80

Extras:

  • Display window – €70

  • Online shop inclusion (see info sheet) – €30

Additionally, the Association receives a 20% commission of the gross sales price for selling the goods.

2. The remaining amount will be transferred or paid in cash to the Designer after a monthly statement.

 

 

§5 Billing and Payment

  1. Booth rent must be transferred monthly at least 7 days before the start of the booking month to the following account (only then is the booking confirmed):

  1. At the end of each booking month, the Association will issue a detailed statement of the products sold.

  2. The Designer’s share will be paid within 14 days of the statement.

  3. Upon request, the Designer can receive a credit note/invoice for the commission.

 

 

 

§6 Duration and Termination

 

1. The contract is concluded for a duration of 2 months and can be extended at any time. A shorter duration is not possible. The contract period begins on 10.05.2025 and ends, unless otherwise agreed, on 10.07.2025.

2. In case of cancellation before the booking start date, the following fees apply:

(a) 14 days or more: 0%
(b) 7–13 days: 20%
(c) 0–7 days: 50%

3. Upon termination of the contract, unsold goods will be returned to the Designer.

 

 

§7 Miscellaneous

  1. Changes and additions to this contract must be made in writing.

  2. Austrian law applies. Place of jurisdiction is Vienna.
